Court Sacks Kogi East Senator, Aidoko

Justice Gabriel Kolawole of the federal high court has ordered the immediate sack of the senator representing Kogi east senatorial district, senator Attai Aidoko of the peoples democratic party (PDP) from the national assembly.

In a judgment on Wednesday, justice Kolawole, who ordered the sack while delivering judgment in a previous pre-election suit, also ordered the clerk of the national assembly to immediately swear in Air Marshall Isaac Alfa (rtd.) of the PDP to take the seat of Aidoko.
The court held that Aidoko was not properly nominated by the PDP for the march 2015 national assembly elections and consequently nullified his election. He ordered INEC to immediately withdraw the certificate of return issued to Aidoko in 2015 for not being the lawful candidate of the PDP
The court also ordered the electoral umpire to issue a fresh certificate of return to Alfa being the winner of the December 7, 2014 PDP primaries into the national assembly election.
Justice Kolawole, who condemned the manner in which the PDP subverted the result of it primaries, held that rogue documents were used by the PDP to submit Aidoko’s name to INEC adding that the documents presented by the defendants were of no probate value for any court of law to rely on.
He said from the totality of the evidence placed before the court, it was clear that Sheidu Idoma was the returning officer for the senatorial election and not Umar Sanusi, and that this was corroborated by key witnesses in their statements made on oath.
Justice Kolawole held that the challenge of the court’s jurisdiction was an abuse of court process because it had earlier been resolved both at the court of appeal and the Supreme Court against the senator.
Consequently, the court awarded a cost of n750, 000 on Aidoko and the PDP respectively.
In the document tendered in court by Isaac Alfa, he scored 129 votes against Aidoko who pulled 101 votes and another senatorial aspirant Halima Alfa who scored 80 votes , the PDP however, while submitting the list of candidates for the senatorial election to INEC substituted Alfa with Aidoko’s name.
Alfa had institute legal action in 2014 to challenge the legality of the candidacy of Aidoko

Flooding: Nigerian Senate Takes Action

Today, the Senate passed a Motion to address the recent flooding across the nation. The Motion, sponsored by Senators Kabiru Gaya and Senator Stella Oduah, and co-sponsored by 105 other Senators, called on the National Emergency Management Agency (NEMA) to immediately send relief materials to the affected victims in states across the federation.
The Senate further called on the Federal Government to convene a stakeholders meeting in collaboration with the Cameroonian Government to scrutinise the recurrent flooding in the country, in order to develop lasting solutions to the problem.
The Senate also urged the Federal Ministry of Water Resources to rehabilitate existing fans and dredge the major rivers to be able to take in flood waters.
The resolution further commended NEMA, the Presidential Committee on Flood Relief (PCFR) and other relevant agencies, organizations and individuals whose efforts in creating awareness have led to reductions in casualty levels.

Senate Continues Process of Confirming Nominees for ICPC

Today, the Nigerian Senate continued the process of confirming the appointment of the Chairman and Members of the Independent Corrupt Practices Commission.
In a motion moved by the Senate Majority Leader, Senator Ahmed Lawan, and seconded by the Senate Minority Leader, Senator Biodun Olujimi, the Senate sent the names of the 9 nominees to its Committee on Anti-Corruption for further screening.
President of the Senate, Dr. Abubakar Bukola Saraki, asked that the Committee report back to the full plenary in two-weeks.

Senate Approves Appointment of Muiz Banire as Chairman of AMCON

Today, the Senate confirmed the appointment of Mr. Banire, Muiz Adeyemi (Ph.D, SAN) for appointment as Chairman of the Governing Board of the Assets Management Corporation of Nigeria (AMCON) in compliance with Section 10(1) of the AMCON Act of 2010.
The motion for consideration of the Report was moved by Senator Rafiu Ibrahim, and seconded by Senator Suleiman Adokwe. The Senate then dissolved into the committee of the whole for the clause-by-clause consideration of the report of Mr. Banire’s appointment, whereafter the nomination was confirmed by the full plenary.

Senate Continues Consideration of INEC 2019 Budget

Today, the Senate continued consideration of the Executive Communication from President Muhammadu Buhari, on the Approval of the Independent National Electoral Commission (INEC’s) 2019) election budget.
The motion for consideration was moved by Senate Leader, Ahmed Lawan, and seconded by Senate Minority Leader, Biodun Olujimi.
President of the Senate, Dr. Abubakar Bukola Saraki, then referred the Executive Communication to the Senate Committee on INEC to report back on the next legislative day.

NASS postpones resumption to October 9

Clerk of the National Assembly, M. A. Sani- Omolori has announced the extension of the annual recess of lawmakers due to activities of the primaries of political parties.

Different political parties would be engaging in primaries to produce flag-bearers of elective positions for the 2019 elections.

The federal legislature was billed to resume on the 25th of September after over two months of break.

But a statement from Omolori declared the new resumption date to be Tuesday, 9th October.

The statement said “all distinguished Senators and Honourable members are expected to resume plenary session by 10 am on the 9th of October, please.”

NASS Joint Committee Approves New Electoral Bill

The National Assembly has produced another version of the electoral act amendment bill addressing concerns raised by president Muhammadu Buhari.

In the latest version which is the 4th in the series, the use of card reader is clearly spelt-out.
The document however eliminates the contentious issues of sequence of elections.

The joint committee on electoral act met for the second time in two days and at the end of the closed door session which lasted several hours, a decision was finally reached on the electoral act amendment bill 2018.
With the lawmakers coming up with what they believe is a clean version for presidential assent.
The latest version which the lawmakers hope would be their final copy is a blend of the older versions albeit with slight but significant amendments.
Quite notable is the outright removal of a poisonous clause on sequence of election.

The new version takes away from the national assembly the power to legislate on local government elections but restores section 138 c & d which explains the grounds on which elections can be challenged.
The new version may have finally rested the controversy over card reader with the lawmakers admitting that card reader was not included in the last version of the bill turned down by president Buhari.

APC Asks Saraki To Reconvene National Assembly Now

The All Progressives Congress (APC) says the People’s Democratic Party (PDP) is hiding under the yet-to-be assented Electoral Act Amendment Bill to draw attention away from what it described as the treasonable actions of the senate president, Bukola Saraki who has refused to convene the National Assembly to consider at plenary the crucial 2019 election budget of the Independent National Electoral Commission (INEC).

The All Progressives Congress therefore, insisted that the National Assembly must be convened immediately.
The party noted that the Electoral Amendment Bill passed by the National Assembly was alive and awaiting assent noting that assent to bills in all democratic governments reflect the prudence and discretion of the president in balancing the powers of key constitutional bodies and understanding the concerns of the executive.
APC condemned what it regarded as the abuse of office by the senate president backed by his PDP cohorts in sabotaging the executive, specifically INEC.
The APC called on all Nigerians, civil society and the international community to resist the on-going travesty and legislative rascality being perpetuated by the senate president and the PDP, saying the sanctity of Nigeria’s electoral system is being threatened by the orchestrated sabotage and deliberate attempt to weaken INEC, as Nigeria prepares for general elections in 2019.

Court halts Saraki from declaring Akpabio’s Seat Vacant

An FCT High Court sitting in Bwari has restrained Senate President Bukola Saraki from declaring the seat of former Minority Leader of the Senate, Godswill Akpabio, vacant.

Justice Othman Musa on Wednesday also ordered Saraki not to impede Senator Akpabio’s access to the Senate building or take any action aimed at “overreaching his privileges and rights as a Senator pending the determination of the originating Summons of the applicant.”

Justice Musa ordered service of the originating Summons and other processes on Saraki through either the Clerk of the National Assembly, Clerk of the Senate or any other Clerk or reasonable staff of the National Assembly at the Assembly complex.
The orders were made after an ex parte application by Akpabio’s lawyers, Chikaosolu Ojukwu and Ebere Ahanonu, seeking to stop moves to declare his seat vacant following his defection from the opposition Peoples Democratic Party to the ruling All Progressives Congress.
The suit has been adjourned to August 29 for further hearing.

Saraki Appoints Onaiwu As Liaison Officer On State Matters

The Senate President, Abubakar Bukola Saraki has appointed Earl Osaro Onaiwu as liaison officer to the senate president on state matters.

This was contained in a statement by special adviser (media and publicity) to senate president Yusuph Olaniyonu.
Onaiwu who is a politician and public administrator will help to co-ordinate relationship between the office of the senate president and the various state governments across the country.
The 56 year old Osaro Onaiwu, was the former director general Nigerian governors’ forum under Former President Goodluck Jonathan.
