Senate Continues Process of Confirming Nominees for ICPC

Today, the Nigerian Senate continued the process of confirming the appointment of the Chairman and Members of the Independent Corrupt Practices Commission.
In a motion moved by the Senate Majority Leader, Senator Ahmed Lawan, and seconded by the Senate Minority Leader, Senator Biodun Olujimi, the Senate sent the names of the 9 nominees to its Committee on Anti-Corruption for further screening.
President of the Senate, Dr. Abubakar Bukola Saraki, asked that the Committee report back to the full plenary in two-weeks.

Recalls that the Disability Bill, 2018 was passed by the Senate and the House of Representatives, and transmitted to the Clerk National Assembly for further legislative action;

Observes that the Directorate of Legal Services scrutinized the Bill in line with its mandate and raised fundamental issues that needed to be addressed, before the Bill could be transmitted for Presidential assent;

Notes that the observations of the Directorate of Legal Services have been communicated to the Senate for further legislative action,

Accordingly resolves to:

Refer the Bill to the Conference Committee that had hitherto worked on the Bill.

4. Approval of the Request for Virement of Funds to Finance the Independent National Electoral Commission (INEC) and Security Agencies towards the Preparation for the 2019 General Elections: Hon. Mustapha Bala Dawaki:

The House:

Recalls that on Wednesday, 18 July, 2018 a Communication from the President of the Federal Republic of Nigeria requesting for Virement of Funds in the Appropriation Act, 2018 was read at Plenary;

Notes that the request was in respect of Virement of Funds to finance INEC and Security Agencies towards the preparation for the 2019 General Elections for which no provisions were made in the 2018 Appropriation Act;

Aware that the Virement has become necessary in order to appropriate funds to enable the relevant Agencies commence preparation towards a free and fair election in 2019;

Also notes that the total amount of Virement being proposed for the INEC and other Security Agencies is N831,259,220,255.00 the breakdown of which is as follows:

1. Independent National Electoral Commission (INEC) N234,507, 272,393.00

2. Office of the National Security Adviser (ONSA) N46,948,839,426.00

3. Department of State Security Service (DSS) N50,791,852,568.00

4. Nigeria Security and Civil Defence Corps (NSCDC) N82,834,042,256.00

5. Nigeria Police Force (NPF) N351,562,210,645.00

6. Nigeria Immigration Service (NIS) N64,615,002,968.00

Resolves to:

Approve the Virement of the Sum of Eight Hundred and Thirty-One Billion, Two Hundred and FiftyNine Million, Two Hundred and Twenty Thousand, and Two Hundred and Fifty-Five Naira (N831,259,220,255.00) only to fund the Independent National Electoral Commission (INEC) and Security Agencies towards the preparation for the 2019 General Elections.

5. Committee on Environment and Habitat: Hon. Obinna Chidoka: “That the House do consider the Report of the Committee on Environment and Habitat on a Bill for an Act to Amend the National Oil Spill Detection and Response Agency (Establishment, Etc.) Act, 2006; and for Related Matters (HB. 964) and approve the recommendations therein” (Laid: 24/7/2018).

6. Committee on Public Petitions Hon. Uzoma Nkem –Abonta: Petition by Walaris Nigeria Limited: “That the House do consider the Report of the Committee on Public Petitions on the Petition by Walaris Nigeria Limited against the Police Service Commission on Non-payment of Contract Debt for the Construction of 400 Linear Meter Wall Fencing at Troop office/Barracks in Kaduna State (Lot1203017) and approve the recommendation therein” (Laid: 17/7/2018);
Urge the Chairman, Police Service Commission to pay the Management of the Walaries Nigeria Limited the sum of N8, 378, 046 with the accrued interest of 10% per annum between 2013 -2018 which amount to N4, 189, 023.09 making a total of N12, 567, 069 as the remaining balance of contract agreement of both parties.
7. Committee on Public Petitions Hon. Nkem –Abonta: Petition by Comrade Kehinde Squad and Co.: “That the House do consider the Report of the Committee on Public Petitions on the Petition by Comrade Kehinde Squad and Co. against the West African Portland Cement PLC, Lafarge, Ewekoro on the lack of commitment to Safety Work Practices as enshrined in the Global Practices by an Employer which resulted in the death of three Company Workers and also NonCommitment to Manpower Development and approve the recommendations therein (Laid: 17/7/2018)”;
(i) Urge the Managing Director of West African Portland Cement Plc to determine the extent of damage done to the deceased family and the host Community and pay them equivalent compensation accordingly;
(ii) Engage the Youth of the Community in the Company work.

8. Committee on Public Petitions: Hon. Uzoma Nkem-Abonta: Petition by Mr. Wodung Adamu Abubakar: “That the House do consider the Report of the Committee on Public Petitions on the Petition by Mr. Wodung Adamu Abubakar against the Federal College of Education, Osiele, Abeokuta, Ogun Sate on the illegal stoppage of salaries and termination of his appointment and approve the recommendations therein” (Laid: 18/7/2018).
(i) Urge the Provost, Federal College of Education, Abeokuta, Dr. Ajayi to reinstate Mr. Wodung Adamu Abubakar back to service as due process was not followed in the termination of his appointment;
(ii) that Mr. Wodung Adamu Abubakar be promoted to be at par with his colleagues in office and be paid all his salary arrears, benefits and other entitlements.

Senate Calls for Release of Leah Sharibu; Observes 2-Minute Silence in Honour of Hauwa Leman

Today, the Nigerian Senate observed a two-minute silence in honour of Hauwa Leman, the International Committee for the Red Cross (ICRC) humanitarian worker that was recently killed by Boko Haram.
Following a Motion raised by the Deputy Senate President, Ike Ekweremadu, and subsequent debate on the issue, the Senate resolved to observe a two-minute silence in honour of the deceased; pay official condolence visits to the families of the deceased; and ensure that the Federal Government, through its security agencies, must do whatever is necessary to guarantee the freedom of both Leah Sharibu and other surviving hostages of the ICRC being held by the insurgents.
Speaking on the resolution, the President of the Senate, Dr. Abubakar Bukola Saraki said:
“Distinguished Colleagues, irrespective of the decision that we have taken, I believe that our committees on defence and security, as part of their own responsibilities should engage with the security agencies to find out if there are other issues that need to be addressed in order to prevent such reoccurrences,” he said.

Today at the Senate received, considered and approved the Report of the Senate Committee on Appropriations on the Budget of Security Agencies for the 2019 General Elections.
The Report, which was laid by Senator Danjuma Goje, the Chairman of the Committee on Appropriations, was seconded by Senator Bassey Akpan, and approved by the plenary.

Flooding: Nigerian Senate Takes Action

Today, the Senate passed a Motion to address the recent flooding across the nation. The Motion, sponsored by Senators Kabiru Gaya and Senator Stella Oduah, and co-sponsored by 105 other Senators, called on the National Emergency Management Agency (NEMA) to immediately send relief materials to the affected victims in states across the federation.
The Senate further called on the Federal Government to convene a stakeholders meeting in collaboration with the Cameroonian Government to scrutinise the recurrent flooding in the country, in order to develop lasting solutions to the problem.
The Senate also urged the Federal Ministry of Water Resources to rehabilitate existing fans and dredge the major rivers to be able to take in flood waters.
The resolution further commended NEMA, the Presidential Committee on Flood Relief (PCFR) and other relevant agencies, organizations and individuals whose efforts in creating awareness have led to reductions in casualty levels.

Senate Approves Appointment of Muiz Banire as Chairman of AMCON

Today, the Senate confirmed the appointment of Mr. Banire, Muiz Adeyemi (Ph.D, SAN) for appointment as Chairman of the Governing Board of the Assets Management Corporation of Nigeria (AMCON) in compliance with Section 10(1) of the AMCON Act of 2010.
The motion for consideration of the Report was moved by Senator Rafiu Ibrahim, and seconded by Senator Suleiman Adokwe. The Senate then dissolved into the committee of the whole for the clause-by-clause consideration of the report of Mr. Banire’s appointment, whereafter the nomination was confirmed by the full plenary.

Senate Continues Consideration of INEC 2019 Budget

Today, the Senate continued consideration of the Executive Communication from President Muhammadu Buhari, on the Approval of the Independent National Electoral Commission (INEC’s) 2019) election budget.
The motion for consideration was moved by Senate Leader, Ahmed Lawan, and seconded by Senate Minority Leader, Biodun Olujimi.
President of the Senate, Dr. Abubakar Bukola Saraki, then referred the Executive Communication to the Senate Committee on INEC to report back on the next legislative day.

NASS postpones resumption to October 9

Clerk of the National Assembly, M. A. Sani- Omolori has announced the extension of the annual recess of lawmakers due to activities of the primaries of political parties.

Different political parties would be engaging in primaries to produce flag-bearers of elective positions for the 2019 elections.

The federal legislature was billed to resume on the 25th of September after over two months of break.

But a statement from Omolori declared the new resumption date to be Tuesday, 9th October.

The statement said “all distinguished Senators and Honourable members are expected to resume plenary session by 10 am on the 9th of October, please.”

NASS Joint Committee Approves New Electoral Bill

The National Assembly has produced another version of the electoral act amendment bill addressing concerns raised by president Muhammadu Buhari.

In the latest version which is the 4th in the series, the use of card reader is clearly spelt-out.
The document however eliminates the contentious issues of sequence of elections.

The joint committee on electoral act met for the second time in two days and at the end of the closed door session which lasted several hours, a decision was finally reached on the electoral act amendment bill 2018.
With the lawmakers coming up with what they believe is a clean version for presidential assent.
The latest version which the lawmakers hope would be their final copy is a blend of the older versions albeit with slight but significant amendments.
Quite notable is the outright removal of a poisonous clause on sequence of election.

The new version takes away from the national assembly the power to legislate on local government elections but restores section 138 c & d which explains the grounds on which elections can be challenged.
The new version may have finally rested the controversy over card reader with the lawmakers admitting that card reader was not included in the last version of the bill turned down by president Buhari.
